Labour leasing in Estonia: legal basics for employers

· 2 min read

Labour leasing (staff rental, tööjõurent in Estonian) is a legitimate, regulated service in Estonia. To make the arrangement safe, it helps to understand how it works legally and who is responsible for what. This article gives a clear overview for employers.

Note: this is a general overview, not legal advice. For specific questions, consult a lawyer.

The three-party structure

Agency work involves three parties: the worker, the staffing agency (the employer), and the user company (the client). The worker has an employment contract with the agency but works at the client’s site under the client’s instructions. This triangle is the defining feature of agency work.

Who is responsible for what

PartyResponsibility
Staffing agencyEmployment contract, pay, taxes, registration (TÖR), insurance
Client (user company)Work organisation on site, on-site safety, instructions
WorkerPerforming the tasks as agreed

A compliant service means workers are registered in the Estonian Employment Register (TÖR) and the service is invoiced with VAT.

Worker rights

Agency workers have the same basic employee rights as regular employees: timely pay, leave, occupational safety and equal treatment. A good agency ensures these rights are protected — which also protects the client’s reputation.

What employers should fix in the contract

  1. Allocation of responsibility — who covers on-site safety and instructions.
  2. Replacement terms — what happens if a worker doesn’t show up.
  3. Pricing — whether the hourly rate includes taxes and VAT.
  4. Confidentiality — if the work touches sensitive areas.

Why compliant employment matters

Informal labour creates legal and reputational risk for the client. Compliant staff rental protects the business: taxes, registration and insurance are in order, and responsibility is clearly allocated. See also our Tallinn staff rental page.

Summary

Labour leasing in Estonia is a regulated triangle: worker, agency and client. The agency covers the employment contract, taxes and registration; the client organises the work on site. Compliant employment protects everyone. If you need a reliable partner, request a quote.
